Terms of Service

1. Agreement to Terms

By accessing or using GetLively ("we", "us", "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

GetLively is a rental matching platform that connects tenants with landlords. We facilitate:

• Property listing creation and management for landlords
• Property search and matching for tenants
• Tenant qualification and verification
• Viewing appointment scheduling and management
• Communication between tenants and landlords

Important: GetLively is a matching platform only. We do not act as a real estate agent, broker, or property manager. All rental agreements and transactions are solely between tenants and landlords.

3. User Accounts

3.1 Account Registration

• You must be at least 18 years old to create an account
• You must provide accurate, current, and complete information
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account

3.2 Account Types

You may register as either a Tenant or a Landlord. You may not maintain multiple accounts of different types or use the Service to circumvent our matching system.

4. User Responsibilities

4.1 For Tenants

• Provide accurate and truthful information in your profile
• Upload authentic documents (ID, SCHUFA, payslips) - falsified documents may result in account termination. Documents are immediately deleted upon admin review and are never stored after verification.
• Respect viewing appointments and communicate cancellations in advance
• Use the Service in good faith and in accordance with applicable laws
• Do not share your account credentials with others

4.2 For Landlords

• Provide accurate and truthful information about properties
• Maintain accurate availability and pricing information
• Respond to tenant inquiries and booking requests in a timely manner
• Respect tenant privacy and comply with data protection laws
• Fulfill viewing appointments as scheduled
• Comply with applicable rental and housing laws

5. Prohibited Activities

You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Upload false, misleading, or fraudulent information or documents
• Harass, abuse, or harm other users
• Impersonate any person or entity
• Attempt to gain unauthorized access to the Service or other users' accounts
• Use automated systems (bots, scrapers) to access the Service
• Interfere with or disrupt the Service or servers
• Violate any applicable laws or regulations
• Use the Service to discriminate on the basis of race, religion, gender, sexual orientation, or other protected characteristics (as prohibited by law)

6. Content and Intellectual Property

6.1 Your Content

You retain ownership of content you submit to the Service (listings, profiles, documents, messages). By submitting content, you grant us a license to use, display, and distribute this content solely for the purpose of operating the Service.

6.2 Our Content

All content on the Service, including but not limited to text, graphics, logos, and software, is the property of GetLively or its licensors and is protected by copyright and other intellectual property laws.

7. Fees and Payment

Currently, GetLively is free to use. We reserve the right to introduce fees in the future. If we do, we will provide advance notice and you may choose to discontinue use of the Service.

Note: Any fees or deposits related to rental properties are agreements solely between tenants and landlords. GetLively is not involved in these transactions.

8. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information in compliance with GDPR.

9. Disclaimers and Limitation of Liability

9.1 Service "As Is"

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

9.2 No Guarantees

We do not guarantee:

• That you will find suitable listings or tenants
• That listings are accurate, available, or legal
• That tenant qualifications or documents are authentic
• That transactions will be successful

9.3 Limitation of Liability

To the maximum extent permitted by law, GetLively shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

Our total liability for any claims arising from or related to the Service shall not exceed €100 or the amount you paid us in the past 12 months, whichever is greater.

10. Indemnification

You agree to indemnify and hold harmless GetLively, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or related to your use of the Service, violation of these Terms, or infringement of any rights of another.

11. Account Termination

We may suspend or terminate your account at any time, with or without cause or notice, for any reason, including if you breach these Terms. You may also delete your account at any time through your profile settings.

Upon termination, your right to use the Service will immediately cease. We may delete your account and data in accordance with our Privacy Policy and data retention policies.

12. Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the Service shall be resolved through good faith negotiation. If a dispute cannot be resolved, it shall be subject to the exclusive jurisdiction of the courts of Germany.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Your continued use of the Service after changes become effective constitutes acceptance of the new Terms.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and GetLively regarding the use of the Service.
